            A statutory meeting of the Knox County Board of Supervisors was held at the Court House in Center, Nebraska on the date of January 12, 2012 at 9:30 a.m.  Present were Supervisors O'Connor Dist. #1, Swanson Dist. #2, Miller Dist. #3, Hanefeldt Dist. #4, Mackeprang Dist. #5, Banks Dist. #6 and Fuchtman Dist. #7. Absent was none. Chairman Mackeprang presiding. 

            Supervisor O’Connor led the Board in the Pledge of Allegiance.

            Chairman Mackeprang announced to the public that a copy of the Public Open Meeting Act was posted in the Boardroom.

Notice of the meeting was given in advance thereof by publication in the Bloomfield Monitor newspaper, as shown by the Affidavit of Publication attached to these minutes.

            Notice of the meeting was simultaneously given to all members and a copy of their acknowledgment and receipt of notice and agenda is attached to these minutes.  All proceedings hereafter shown were taken while the convened meeting was opened to the attendance of the public.

            The following people were present at the meeting during various times: Hwy. Supt. Barta, Wausa Gazette Reporter Deanna Anderson, Co. Assessor McManigal, Emergency Mgr. Hintz, Zoning Admin. Doerr, Co. Treas. Stark, Angie O’Connor, Clk. of Dist. Crt. Riesberg, Del Fuelberth and Econ. Dev. Director Tauber.  

            Minutes of the December 29, 2011 meeting were read.  Chairman Mackeprang approved the December 29, 2011 minutes as read with the correction that the Audit Report/Financial Statement placed on file was for the fiscal year ending June 30, 2011.

            Correspondence reviewed was: 1. Letter from Jerry L. Berggren with Berggren Architects regarding installation of an elevator in the Courthouse.

The Knox County Board of Supervisors reconvened at 9:47 a.m., as provided by Sec. 23-272, 23-274 Revised Statutes of Nebraska 1943 (Reissue of 1997).

Motion by O’Connor, seconded by Fuchtman to appoint County Clerk Fischer as Temporary Chairman of the Knox County Board of Supervisors due to the reorganization process.  By roll call vote.  Ayes all Districts.  Nays none.    Motion carried.

            Temporary Chairman/Co. Clk. Fischer called for nominations three times from the floor for Chairman of the Knox County Board of Supervisors.  Supervisor Swanson nominated Supervisor Mackeprang. 

                Motion by Swanson, seconded by Fuchtman that nominations cease, rules are suspended and to cast a ballot for Supervisor Mackeprang for Chairman of the Knox County of Board of Supervisors for 2012.  By roll call vote.  Ayes Dist. #1, #2, #3, #4, #6 and #7.  Nays none.  Abstain Dist. #5.  Motion carried.   Supervisor Mackeprang assumed the duties of the Chairman of the Knox County Board of Supervisors for 2012.

            Chairman Mackeprang called for nominations three times from the floor for Vice-Chairman of the Knox County Board of Supervisors.  Supervisor Fuchtman nominated Supervisor Miller. 

            Motion by Fuchtman, seconded by Hanefeldt that nominations cease, rules are suspended and to cast a unanimous ballot for Supervisor Miller for Vice-Chairman of the Knox County Board of Supervisors for 2012.  By roll call vote.  Ayes Dist. #1, #2, #4, #5, #6 and #7.  Nays none. Abstain Dist. #3.  Motion carried.  Supervisor Miller assumed the duties of the Vice-Chairman of the Knox County Board of Supervisors for 2012.

                Motion by Banks, seconded by Miller to retain Kevin R. Barta as County Highway Superintendent for the ensuing year.  Motion by Fuchtman to amend the main motion by adding “and to set his 2012 wage at the rate of an elected official plus $4,875 of the incentive payment that the County receives from the State Dept. of Roads”.  Supr. O’Connor seconded the motion to amend the main motion.  By roll call vote on the motion to amend the main motion.  Ayes all Districts.  Nays none.  Motion carried.  By roll call vote on the main motion with the amendment.  Ayes all Districts.  Nays none.  Motion carried.

            Motion by O’Connor, seconded by Hanefeldt to authorize Co. Treasurer Stark to invest all funds of the County for the calendar year 2012.  By roll call vote.  Ayes all Districts.  Nays none.  Motion carried.

Motion by Miller, seconded by Banks to set the 2012 salary for Veterans’ Service Officer Leonard R. Boggs at $18.79 per hour.  By roll call vote.  Ayes all Districts.  Nays none. Motion carried.

Motion by O’Connor, seconded by Swanson to designate publishing and posting requirements of 2012 Notices of Meeting for the Knox County Board of Supervisors as follows:  All 2012 Notices of Meeting to be posted on the Knox County Website being www.co.knox.ne.us; the Notice of Meeting for the first regular meeting of each month be published in the Bloomfield Monitor, the Notice of Meeting for the second regular meeting of each month be published in the Verdigre Eagle; special meeting/quorum meeting notices be published in both the Bloomfield Monitor and the Verdigre Eagle. By roll call vote.  Ayes all Districts.  Nays none.  Motion carried.

          Chairman Mackeprang moves the Board recess at 10:11 a.m. for Board of Equalization.

            The Knox County Board of Supervisors reconvened at 10:23 a.m. with all members present.

            Hwy. Supt. Barta met with the Board on the following: 1. Motion by Banks, seconded by O’Connor to accept the State bid through Sid Dillon for two 2012 Chevrolet 1500 regular cab, 4x4 pickups with on/off road mud/snow tires and 5.3 l. engine at $21,780 each with the option of adding heavy springs at an additional cost with pickups going to Districts 2 and 3.  By roll call vote.  Ayes all Districts.  Nays none.  Motion carried; 2.  Discussed a 2012 Fracture Critical Bridge Inspection Agreement.  Knox County has 43 fracture critical bridges and the cost to the County will be $19,177.94 for its share of the inspection agreement.  Motion by Fuchtman, seconded by Swanson to adopt Resolution #2012-01 to authorize Chairman Mackeprang to sign the St. of Nebraska Agreement for Consultant Inspection and Re-Load Rating on County Fracture Critical Bridges.  By roll call vote.  Ayes all Districts.  Nays none.  Motion carried.

 

RESOLUTION #2012-01

SIGNING OF AN ENGINEERING SERVICES AGREEMENT

FOR FRACTURE CRITCAL BRIDGE INSPECTIONS – KNOX COUNTY

 

Whereas: the Nebraska Department of Roads (NDOR) is developing a transportation project on the behalf of the county, for which it intends to obtain Federal funds;

Whereas: Knox County as a sub-recipient of Federal-Aid funding is charged with the responsibility of expending said funds in accordance with Federal, State and local laws, rules, regulations, policies and guidelines applicable to the funding of the Federal-aid project;

Whereas: Knox County and the NDOR wish to enter into an Engineering Services Agreement to provide fracture critical bridge inspection and re-load rating (if necessary) services for the Federal-aid project.

Be It Resolved: by the Board of Supervisors of Knox County that:  Norman Mackeprang, Chairperson of the Board is hereby authorized to sign the attached Engineering Services Agreement between Knox County and the NDOR.

            Hwy. Supt. Barta continued with the following: 3. A Safety Meeting was held before this meeting.  County shed inspections will be held January 24, 2012 and NIRMA will hold a training session on February 2, 2012 at the Center Community Hall.  Employees of Knox County can participate in a defensive driving session, a slips/trips and fall session and a fire extinguisher session on that date; 4.  Discussed drug/alcohol testing of County employees who have a CDL or possibly adding inside employees to the testing pool as some drive the County van.  Hwy. Supt. Barta will get more information about drug testing of employees; 5.  Motion by Swanson, seconded by Banks to go into executive session at 10:50 a.m. for personnel so as to protect the reputation of individuals when discussing applications for bridge crew foreman.  By roll call vote.  Chairman Mackeprang reiterated that an executive session will be held on personnel so as to protect the reputation of individuals when discussing applications for bridge crew foreman.  The Board came out of executive session at 11:07 a.m.  Chairman Mackeprang stated that the executive session was held solely on personnel for the review of the applications for bridge crew foreman.

            After a discussion, motion by Swanson, seconded by Hanefeldt to promote Jason Doerr to the Bridge Crew Foreman position.  By roll call vote.  Ayes Dist. #1, #2, #3, #4, #6 and #7.  Nays none.  Abstain Dist. #5.  Motion carried.

            Sheriff Henery requested an executive session to discuss personnel.  Motion by O’Connor, seconded by Banks to go into executive session at 11:08 a.m. for personnel so as to protect the reputation of individuals. By roll call vote.  Ayes all Districts.  Nays none.  Motion carried.  Chairman Mackeprang reiterated that an executive session will be held on personnel so as to protect the reputation of individuals.  The Board came out of executive session at 11:25 a.m.  Chairman Mackeprang stated that the executive session was held solely on personnel.

            Angie O’Connor with Avera met with the Board on a Wellness Program.  There is a $200 credit for Knox County from the 2011 Wellness Program that can be applied to this year’s program.  The general package is available again this year but several options were discussed.  A mobile mammography unit could come to the Courthouse if enough employees would want to use it and the cost would be paid through the employee’s health insurance company.  A survey of employees will be held to see if the required number would use the mobile unit.  After a discussion, motion by Miller, seconded by Swanson to contract with Avera for an on-site Wellness Program for Knox County employees with the cost to be $100 per participating employee for the annual Health Fair & Health Risk and Assessment, with the additional option of  PSA testing for men over 40 years of age at $20 and CMP testing at $12 per person, the cost of the program to be taken from the County Insurance Fund, and to those eligible employees who participate in the 2012 Wellness Program and are covered under the County’s health insurance, reimbursement up to $250 of 2012 deductible paid between $250 and $500; for those employees who pay for child(ren) health insurance coverage through HealthCare Solutions Group, Inc.,  reimbursement  up to $250 of 2012 deductible paid between $250 and $500 provided the employee participates in the 2012 Wellness Program; and for those employees who pay for spouse coverage through HealthCare Solutions Group, Inc., reimbursement of up to $250 of 2012 deductible paid between $250 and $500, provided the spouse participates in the 2012 Wellness Program.  By roll vote.  Ayes Dist. #2, #3, #4, #5, #6 and #7.  Nays none.   Abstain Dist. #1.  Motion carried.

            Steve Mietz, Superintendent of the Missouri National Recreational River/National Park Service met with the Board about new land protection planning to conserve stretches of the Missouri River that are significant for natural resources and to enhance recreation.  Meetings will be held in the near future in Niobrara, Vermillion and Sioux Falls. 

            Chairman Mackeprang moves the Board recess at 12:00 p.m.

            The Knox County Board of Supervisors reconvened at 12:40 p.m. with all members present.

Motion by O’Connor, seconded by Hanefeldt to go into executive session at 12:42 p.m. to discuss pending litigation.  By roll call vote.  Ayes all Districts.  Nays none.  Motion carried.  Chairman Mackeprang reiterated that the executive session was held on pending litigation.  The Board came out of executive session at 12:57 p.m.  Chairman Mackeprang stated that the executive session was held solely on pending litigation.

Motion by O’Connor, seconded by Hanefeldt that all claims audited and approved for payment or rejected by the Claims Committee, except General Fund Claim #1200 in the amount of $50, be allowed or rejected subject to delinquent personal taxes. By roll call vote.  Ayes all Districts.  Nays none. Motion carried.   

Motion by Hanefeldt, seconded by O’Connor that General Fund Claim #1200 in the amount of $50 payable to the Knox County Economic Development to be applied to a borrower’s delinquent reuse loan, audited and approved for payment or rejected by the Claims Committee be allowed or rejected subject to delinquent personal taxes. By roll call vote.  Ayes all Districts.  Nays none. Motion carried.

Motion by Banks, seconded by Hanefeldt to go into executive session at 1:03 p.m. on contract negotiations on the USDA Revolving Loan Program.  By roll call vote.  Ayes all Districts.  Nays none.  Motion carried.  Chairman Mackeprang reiterated that the executive session will be held on contract negotiations on the USDA Revolving Loan Program.  The Board came out of executive session at 1:25 p.m.  Chairman Mackeprang stated that the executive session was held solely on contract negotiations.

Hank Schollmeyer with Liberty National Insurance Company updated the Board on the progress of contacting the employees about his insurance company’s products.

Del Fuelberth with Beckenhauer Construction Company of Norfolk presented information about the company’s  procedures of working as construction managers and how they work with architects and contractors on building projects.

Due to a scheduling conflict with the NACO County Board Workshop, consensus of the Board was to change the first meeting date in February to Monday, February 13, 2012 beginning at 9:00 a.m.

Motion by Fuchtman, seconded by Miller to place on file the Co. Treasurer’s Semi-Annual Report of Summary of Collections, Disbursements and Balances for Six Months ending December 31, 2011 and that there were no unpaid claims against Knox County as of December 15, 2011.  By roll call vote.  Ayes all Districts.  Nays none.  Motion carried.

Motion by O’Connor, seconded by Swanson to place on file the Clerk of District Court December Fee Report.  By roll call vote.  Ayes all Districts.  Nays none.  Motion carried.

Motion by Swanson, seconded by Banks to approve an annual membership with the Missouri Sedimentation Action Coalition and to pay the $1,000 membership fee from the Flowage Easement Road Fund.  By roll call vote.  Ayes all Districts.  Nays none.  Motion carried.

Zoning Admin. Doerr met with the Board on the following: 1. Motion by Miller, seconded by Banks to place on file the December 13, 2011 Planning Commission minutes, the December Permits Report, the 2011 Permits Report and a Township Summary since the late 1990’s of permits issued and valuation of construction.  By roll call vote.  Ayes all Districts.  Nays none.  Motion carried; 2. Update on the Planning Commission meeting.  A public hearing on the Zoning Regulations will be held on Feb. 28 at Bloomfield.  After the hearing, the Planning Commission will make a recommendation to the Board, the Board will have to hold a public hearing and then they have 90 days to approve or deny the regulations.

Supr. Miller gave an update on the elevator project.  Gilmore and Associates will proceed with plans provided a $4,500 fee is paid.  Also, he has been in contact with Jerry Berggren who is working on an alternative addition to the Courthouse that would house an elevator.  If an addition is made for the elevator, the cost would be from 30% to 50% more than installing the elevator within the Courthouse.  Mr. Berggren invited the Board to view some of their projects around Nebraska.

PROCEEDINGS OF THE KNOX COUNTY BOARD OF EQUALIZATION

            A regular meeting of the Knox County Board of Equalization was held at the Court House in Center, Nebraska on the date of January 12, 2012 at 10:00 a.m.  Present were Supervisors O’Connor, Dist. #1, Swanson Dist. #2, Miller Dist. #3, Hanefeldt Dist. #4, Mackeprang Dist. #5, Banks Dist. #6 and Supervisor Fuchtman Dist. #7.  Absent was none.  Chairman O’Connor presiding.  Also present were Co. Assessor McManigal, Deputy Assessor Beckmann, Hwy. Supt. Barta and Wausa Gazette Reporter Deanna Anderson.

Chairman O’Connor announced to the public that a copy of the Public Open Meeting Act was posted in the Boardroom.

            Notice of the meeting was given in advance thereof by publication in the Bloomfield Monitor newspaper, as shown by the Affidavit of Publication attached to these minutes.

            Notice of this meeting was simultaneously given to all members and a copy of their acknowledgment and receipt of notice and agenda is attached to these minutes.  All proceedings hereafter shown were taken while the convened meeting was opened to the attendance of the public.

The minutes of the December 29, 2011 meeting were read.  Chairman O’Connor approved the December 29, 2011 minutes as read with the correction that Deputy Assessor Beckmann was present and that Supr. Hanefeldt’s motion on Special Valuation was for the comparison on grassland, not agland.

Motion by Fuchtman, seconded by Hanefeldt to appoint County Clerk Fischer as Temporary Chairman of the Knox County Board of Equalization due to the reorganization process.  By roll call vote.  Ayes all Districts.  Nays none.  Motion carried.

            Temporary Chairman/Co. Clk. Fischer called for nominations three times from the floor for Chairman of the Knox County Board of Equalization.  Supervisor Fuchtman nominated Supervisor O’Connor.

            Motion by Hanefeldt, seconded by Miller that nominations cease, rules are suspended and to cast a unanimous ballot for Supervisor O’Connor for Chairman of the Knox County Board of Equalization for 2012.  By roll call vote.  Ayes Dist. #2, #3, #4, #5, #6 and #7.  Nays none.  Abstain Dist. #1.  Motion carried.  Supervisor O’Connor assumed the duties of the Chairman of the Knox County Board of Equalization for 2012.

            Chairman O’Connor called for nominations three times from the floor for Vice-Chairman of the Knox County Board of Equalization.  Supervisor Fuchtman nominated Supervisor Miller.

            Motion by Banks, seconded by Mackeprang that nominations cease, rules are suspended and to cast a unanimous ballot for Supervisor Miller for Vice-Chairman of the Knox County Board of Equalization for 2012.  By roll call vote.  Ayes Dist.#1, #2, #4, #5, #6 and #7.  Nays none.  Abstain Dist. #3.  Motion carried.  Supervisor Miller assumed the duties of the Vice-Chairman of the Knox County Board of Equalization for 2012.

                Motion by Miller, seconded by Banks to designate publishing and posting requirements of 2012 Notices of Meeting for the Knox County Board of Equalization as follows:  All 2012 Notices of Meeting to be posted on the Knox County Website being www.co.knox.ne.us; the Notice of Meeting for the first regular meeting of each month be published in the Bloomfield Monitor, the Notice of Meeting for the second regular meeting of each month be published in the Verdigre Eagle; special meeting/quorum meeting notices be published in both the Bloomfield Monitor and the Verdigre Eagle. By roll call vote.  Ayes all Districts.  Nays none.  Motion carried.

There was no public comment on agenda items.

            Public comment on non-agenda items was given by Chairman O’Connor when he asked about the progress of setting a date for Ruth Sorensen with Property Assessment Division to meet with the Board.  Co. Assessor McManigal and Supr. Hanefeldt have not received a confirmation from the Division.

            Chairman O’Connor adjourned the Knox County Board of Equalization at 10:23 a.m. on January 12, 2012 until 9:45 a.m. on Thursday, January 26, 2012 for a regular meeting.
