PROCEEDINGS OF THE KNOX COUNTY BOARD OF SUPERVISORS

            A regular meeting of the Knox County Board of Supervisors was held at the Court House in Center, Nebraska on the date of April 30, 2012, at 9:30 a.m.  Present were Supervisors Swanson Dist. #2, Miller Dist. #3, Hanefeldt Dist. #4, Mackeprang Dist. #5, Banks Dist. #6 and Fuchtman Dist. #7.  Absent was Supervisor O’Connor Dist. #1.  Chairman Mackeprang presiding.

Supr. Fuchtman led the Board in the Pledge of Allegiance.           

            Chairman Mackeprang announced to the public that a copy of the Public Open Meeting Act was posted in the Boardroom.

            Notice of the meeting was given in advance thereof by publication in the Verdigre Eagle newspaper, as shown by the Affidavit of Publication attached to these minutes.

            Notice of this meeting was simultaneously given to all members and a copy of their acknowledgment and receipt of notice and agenda is attached to these minutes.  All proceedings hereafter shown were taken while the convened meeting was opened to the attendance of the public.

            The following people were present at various times during the meeting:  Wausa Gazette Reporter Deanna Anderson, Hwy. Supt. Barta, Co. Attorney Thomas, Sheriff Henery, 911 Coordinator Janecek, Tom Kotrous, Co. Surveyor Skroch and Zoning Admin. Doerr.

            Correspondence reviewed was: 1. Letter from Nebraska Commission on Law Enforcement and Criminal Justice stating that the annual inspection by the Nebraska Jails Standards Board will be held on May 4, 2012.

The minutes of the April 12, 2012 meeting were read.  Chairman Mackeprang approved the April 12, 2012 meeting minutes as read.

Chairman Mackeprang moves the Board recess at 9:53 a.m. for Board of Equalization.

The Knox County Board of Supervisors reconvened at 10:07 a.m. with all members present except Supr. O’Connor Dist. #1.

Hwy. Supt. Barta met with the Board on the following: 1. Bridge crew update; 2. Oil crew update.  A request was received from Rolling Hills Golf Course to have the County oil about 26 feet of the driveway into the golf course.  The estimated cost would be approximately $2,500 to $3,000.  Consensus of the Board was to not oil the Rolling Hills Golf Course driveway; 3. Update on the Lindy North BIA Road Project.  Bid letting will be held in May; 4.  Update on the transportation training; 5.  Update on the NIRMA Road Liability training; 6.  Supr. Fuchtman informed the Board that a new mower is needed at the Creighton County Yard; 6.  Putting on a larger fuel tank on a bridge truck.

Supr. Hanefeldt updated the Board on his recent trip to Washington D. C. that he, his wife, Dixie, and the South Dakota delegation took.  The group visited the offices of Congressman Adrian Smith, and of Senators Ben Nelson, Mike Johanns, John Thune, and Tim Johnson.  Supr. Hanefeldt thanked the Board for the opportunity to represent Knox County in Washington D. C. 

Motion by Swanson, seconded by Banks to pay dues of $300 to the Northeast Nebraska RC&D and to inform them that they should apply for visitors’ promotion funds from the Knox County Visitors’ Committee.  By roll call.  Ayes Districts #2, #3, #4, #5, #6 and #7.  Nays none.  Absent was District #1.  Motion carried.

Motion by Fuchtman, seconded by Banks to go into executive session at 10:43 a.m. to protect the reputation of an individual while discussing personnel.  By roll call vote.  Ayes Districts #2, #3, #4, #5, #6 and #7.  Nays none.  Absent was District #1.  Motion carried.  Chairman Mackeprang reiterated that the executive session will be held to protect the reputation of an individual while discussing personnel.  The Board came out of executive session at 10:53 a.m.  Chairman Mackeprang stated that the executive session was held solely on personnel.

Sheriff Henery informed the Board that the Fire Marshall inspected and approved the Knox County Jail.

Hannah Kast, a Crofton Community School 8th grader and the 2012 Knox County Spelling Bee Champion of the 7th/8th grade competition, sent a letter to the Board highlighting her experience at the Midwest Spelling Bee in Omaha.  The Board commended her on her hard work.

Motion by Swanson, seconded by Miler to place on file the County Sheriff’s Quarterly Report of Fees Collected January 1, 2012 through March 31, 2012.  By roll call vote. Ayes Districts #2, #3, #4, #5, #6 and #7.  Nays none.  Absent was District #1.  Motion carried.

Motion by Swanson, seconded by Miller to send a Letter of Support to the Northeast Community College for their application to the Economic Development Administration and Department of Agriculture for a grant for the rural revitalization initiative and to develop an entrepreneurship center.  By roll call vote.  Ayes Districts #2, #3, #4, #5, #6 and #7.  Nays none.  Absent was District #1.  Motion carried.

A request was received from a Crofton High School Government teacher that a County Board meeting be held in Crofton so his students could attend the meeting.  Discussion was held on the issue of other officials who meet with the Board regularly would have to travel to Crofton, accommodations could be made at the Courthouse for the students to attend a Board meeting if advance notice was given, and that the students are always welcome to attend the annual County Government Day.  Motion by Fuchtman, seconded by Swanson to deny the request to hold a Board meeting in Crofton.  By roll call vote.  Ayes Districts #2, #3, #4, #5, #6 and #7.  Nays none.  Absent was District #1.  Motion carried.

Consensus of the Board was that the payroll schedule for Knox County employees will be as follows:  payroll for inside employees will be the second Thursday of each month, payroll for outside employees will be the last Thursday of each month, and if a holiday falls on either the second or last Thursday of a month, payroll will be the Wednesday prior to the holiday.

            At 11:05 a.m., the Board took a 5-minute break.

Insurance Agent Jeff Hammer presented information on life insurance through Lincoln Financial Group of Omaha.  As the Aetna Life Insurance premiums increased by 24.22%, Mr. Hammer researched alternative companies and coverage and thought the Lincoln Financial Group’s insurance would be comparable to the Aetna coverage but at a cheaper rate.  Also, the employees would have an opportunity to purchase more coverage through the Lincoln Financial Group than was available with Aetna.  Motion by Miller, seconded by Fuchtman to change the life insurance coverage from Aetna Life Insurance to Lincoln National Life Insurance Company through Lincoln Financial Group of Omaha effective June 1, 2012.  By roll call vote.  Ayes Districts #2, #3, #4, #5, #6 and #7.  Nays none.  Absent was District #1.  Motion carried.

            911 Coordinator Janecek updated the Board on the purchase of the new 911 equipment.  While the State Advisory Board approved the purchase, the Public Service Commission has not yet given final approval that wireless service funds can be used towards the purchase of the equipment.  An additional telephone line will be needed as well as texting software.  911 Coordinator Janecek said that the equipment would cost $194,922.89, asked that the funds be paid from the Inheritance Fund and the amount be paid back to the Inheritance Fund annually by the 911 Wireless Service Fund (55%) and the 911 Emergency Fund (45%) over a 5-year period.  Consensus of the Board was to pay for the new 911 equipment in the amount of $194,922.89 from the Inheritance Fund, the amount to be paid back to the Inheritance Fund with no interest charge, by the 911 Wireless Service Fund and the 911 Emergency Fund over a 5-year period with no early pay-back penalty, contingent upon County Attorney Thomas’ approval and drafting of a resolution and promissory note. 

Supr. Swanson updated the Board that Niobrara High School students received the 2011 EPA Region 7 President’s Environmental Youth Award for their continued involvement on a Purple Loosestrife Project. 

Motion by Hanefeldt, seconded by Fuchtman that the receipts be accepted and placed on file, by roll call vote.  Ayes Districts #2, #3, #4, #5, #6 and #7.  Nays none.  Absent was District #1.  Motion carried.  Receipts totaled $161,035.12.

There was no public comment on agenda items.

Comment on non-agenda items was given by Supr. Miller.  A letter was received from Berggren Architects for proposed tasks to accomplish a Long Range Strategic Master Plan for the Courthouse and installation of an elevator.  Copies were given to the Board members to review before the next meeting.

The Board made a quarterly visit to the Knox County Jail as per Nebraska Revised Statute 47-109.

Chairman Mackeprang moves the Board recess at 12:00 p.m. for lunch.

The Knox County Board of Supervisors reconvened at 12:50 p.m. with all members present except Supr. O’Connor Dist. #1. 

Motion by Hanefeldt, seconded by Fuchtman that all claims, audited and approved for payment or rejected by the

  Claims Committee be allowed or rejected subject to delinquent personal taxes. By roll call vote.  Ayes Districts #2, #4, #5,

  #6 and #7.  Nays none.  Abstain District #3.  Absent was District #1.  Motion carried.  Claims totaling $135,275.93 are listed

  at the end of these proceedings.

Chairman Mackeprang opened the advertised public hearing at 1:00 p.m. for consideration of the Tin City Recreational Area plat that is located in the W1/2SW1/4 of Section 17, T33N, R7W, Knox County, Nebraska. 

Zoning Admin. Doerr met with the Board on the following: 1.  Motion by Banks, seconded by Swanson to approve the zoning lot split for Jeffrey Rodgers on a 6.096 acre tract in the SE1/4SW1/4 of Section 8, T29N, R2W of the 6th P.M., Knox County, Nebraska.  By roll call vote.  Ayes Districts #2, #3, #4, #5, #6 and #7.  Nays none.  Absent was District #1.  Motion carried; 2.  Discussion was held on filling Mike Maxwell’s position on the Board of Adjustments due to his resignation.  An email was received that Tom Pavlik was interested in the position.  The matter will be discussed at the  May 10, 2012 meeting so Supr. Banks can inquire if there are any interested parties in his area since Mike Maxwell was from the Wausa area; 2, The Dept. of Natural Resources will hold a meeting at the Bloomfield Community Center at 1:00 p.m. on June 1, 2012 regarding flood plain mapping.  The meeting is being held due to a request from FEMA.

Chairman Mackeprang closed the open public hearing on the Tin City Recreational Area plat at 1:30 p.m.  There

  was no one present during the hearing in opposition to the plat.   Motion by Swanson, seconded by Fuchtman to adopt

  Resolution #2012 – 21 to adopt the plat for Tin City Recreational Area that is located in the W1/2SW1/4 of Section 17,

  T33N, R7W, Knox County, Nebraska.  By roll call vote.  Ayes Districts #2, #3, #4, #5, #6 and #7.  Nays none.  Absent was

  District #1.  Motion carried.

Public comment on non-agenda items was given by Tom Kotrous.  He was concerned about finding information in the newly adopted Zoning Regulations.  Zoning Admin. Doerr said that it was her goal to try to make the regulations easier to research by putting information under districts and that there are some regulations that are the same for every district so are not repeated.  Mr. Kotrous was also concerned about the processes and delays to obtain a FEMA grant.

A regular meeting of the Knox County Board of Equalization was held at the Court House in Center, Nebraska on the date of April 30, 2012 at 9:53 a.m.  Present were Supervisors Swanson Dist. #2, Miller Dist. #3, Hanefeldt Dist. #4, Mackeprang Dist. #5, Banks Dist. #6 and Fuchtman Dist. #7.  Absent was O’Connor Dist. #1.  Vice-Chairman Miller presiding.  Also present was Deputy Co. Assessor Beckmann.

Motion by Hanefeldt, seconded by Mackeprang  that the Tax Claims Committee recommendation on Tax Claims #7721, #7722 and #7723 be accepted and granted and the County Assessor is hereby directed to execute the proper adjustments on the tax records by roll call vote.  Ayes Districts #2, #3, #4, #5, #6 and #7.  Nays none.  Absent was     District #1.  Motion carried.

Motion by Fuchtman, seconded by Swanson to place on file Notices of Rejection of Homestead Exemptions.  By roll call vote.  Ayes Districts #2, #3, #4, #5, #6 and #7.  Nays none.  Absent was District #1.  Motion carried.

Vice-Chairman Miller adjourned the Knox County Board of Equalization at 10:07 a.m. on April 30, 2012 until 9:45 a.m. on Thursday, May 10, 2012 for a regular meeting.
